Terms & Conditions

All Terms & Conditions of Luke Sutton Productions are agreed to by the client prior to the start of the job by the client receiving our written quotation, instructing us and paying their 50% non-refundable deposit. Luke Sutton Productions Terms & Conditions are included for the client’s sight and consideration in every written quotation.

Insurance Our Public Liability insurance for aerial drone footage is  ten million pounds.

Our Public Liability insurance for all other work including Videography and Photography within the UK and EU is £1,000,000.

Our equipment is fully insured.

Qualifications & Training

Luke Sutton Productions hold Permission for Commercial Operations (PfCO) from the United Kingdom Civil Aviation Authority (UK CAA) via training and assessment by the UAV Academy https://uavacademy.co.uk/.

Quotations

Luke Sutton Productions are able to provide fixed price quotations to all industries, including public sector organisations.

All quotations and instructions are subject to Luke Sutton Productions Terms & Conditions.

Information Required The client is required to complete our enquiry form via our website www.lukesuttonproductions.co.uk or www.certifieddronepilot.co.uk, which will provide us with necessary details such as the exact location (an accurate postcode of the location to be filmed/photographed is vital), the proposed date(s) and as much background information as possible on what you want us to film and/or photograph.

Site Survey for Drone Footage

Once we have all of the required information from you we can then carry out an initial online site survey to see if the flight will most likely be possible and if there are any factors to be considered such as flight restrictions and permissions needing to be obtained. This is required in order to comply with the CAA’s rules and restrictions and will help us to provide the most accurate quotation to you, the client.

If our initial online site survey proves to be successful we will send you our written quotation.

VAT Our prices are not including or subject to VAT.

Expenses

We bill travel mileage in the UK at a rate of 45 pence per mile and we bill travel expenses within the UK such as accommodation or transport fares on an individual basis.

We bill travelling expenses outside of the UK on an individual basis.

All travel expenses will be estimated in our quotation to the client and, if found to be higher than the original estimation at the point of booking, will be agreed with the client prior to booking by Luke Sutton Productions.

Booking

If you are happy with our written quotation the 50% booking deposit will need to be paid in order to secure our services. We may then arrange a visit of the site in person in order to ensure all factors and possible restrictions have been considered and to discuss the final arrangements.

Please note that we are unable to proceed with any planning or the job itself until the 50% deposit has been paid. We will then be in a position to consider and agree a date to carry out the work.

Pre-Flight Site Survey for Drone Footage

In order to comply with the CAA’s rules and restrictions of our Permission for Commercial Operations (PfCO) we are required to complete a thorough pre-flight survey – this is in addition to the initial online site survey we will have completed at the quotation stage and may require us to visit the site in person in order to ensure all factors and possible restrictions have been considered. There are a number of variables that can impact drone operation but we research thoroughly and plan ahead to decrease the likelihood of any possible issues.

Weather

PLEASE NOTE: We cannot operate any of our equipment externally, especially our drones, in rain or high winds. Any specific requirements that the client may have will also potentially restrict us to flying at specific times.

Aerial drone operation, videography and photography is affected by the weather. Due to the changeability of the weather, especially in the UK, we have a flexible approach to scheduling each job – we research and predict the weather forecast 3 days in advance of any job, if required.

If we feel the predicted weather conditions will have a negative impact on our ability to fulfil the job we will contact the client 48 hours prior to the planned date in order to discuss the issue.

We may then re-schedule the job to the next suitable date at no additional cost to the client and the 50% booking deposit from the client will be transferred to the new date.

If both parties agree to continue with the original scheduled date despite the likely poor weather, our pilots will wait on site as long as possible (within the confines of the previously agreed job timings) in the hopes of a break in the weather.

If we arrive on site and are unable to complete the job on the day for any unforeseen circumstance or due to the predicted poor weather we will charge in full. We will offer the client a 20% discount off the price of a re-booking though.

Cancellation

Our 50% booking deposit is non-refundable. This is due to the amount of planning and research required and our availability having been secured for the particular client, resulting in a possible loss of income if the job does not proceed.

If the client cancels the job within 7 days of the scheduled date the client will be liable for the full cost detailed in the written quotation and any expenses already incurred by Luke Sutton Productions.

If it is necessary for the job to be re-scheduled but it is found to not be possible due to factors out of our control (live events, client availability, etc.) Luke Sutton Productions does not offer a refund of the 50% booking deposit.

If we arrive on site and are unable to complete the job on the day for any unforeseen circumstance or due to the predicted poor weather we will charge in full. We will offer the client a 20% discount off the price of a re-booking though.

Copyright and Use of Material

Luke Sutton Productions retains the copyright of all footage and images – aerial drone videography and photography, videography, photography and logo design.

We are able to negotiate and agree a buy-out of footage for specific filming contracts.

The client has full use of all footage and images for their own business promotion and use of by their suppliers for media, print, marketing, advertising and website use.

The client and their suppliers are not permitted to sell or alter the material or allow the use of the material by general third parties without prior written consent by us.

We, Luke Sutton Productions, promote our own business and services using examples of our work via our website portfolios and a range of media tools and services. We reserve the right to use any footage, video, photograph, still image or image for our own purposes including on our websites and on social media.

As a provider of services to military contractors we are fully aware of and experienced in client confidentiality, embargo provisions and Non-Disclosure Agreements. Luke Sutton Productions agrees not to use any footage or images until the client has authorised and published the material their-selves.

Luke Sutton Productions reserves the right to supply footage and images to stock libraries at a later date.
